having maintained at its expense may have worked here, I believe.
MatthewLaSon Apr 28, 2009:
Yes, I agree with you Nikki.
Nikki Scott-Despaigne Apr 28, 2009:
To Matthew I agree that there is room for ambiguity but the main thing is that the cost of indemnifying the clients has been shared.
MatthewLaSon Apr 28, 2009:
meaning Aren't they just saying that "Société XXX" has held up its end of the stick as far paying compensation is concerned (in more informal terms, if you wil).

bear the cost of

What makes this extract awkward is that "conserver" is being used. The second company is covering the cost of indemnities paid over to clients. It is about who is bearing what portion of the indemnities paid out.

If you turn the sentence round a little, you can use the more classic formulation of "bear the cost of", thus :

"XYZ Assurances certifies having indemnified all of its French, Belgian and Dutch clients in the sum of 1 518 141 €, the company XXX having borne the cost of the indemnities paid over to clients in the sum of 433 308 €."

"certifies" may not be quite right in fuller context.

Insurance Indemnisation Vs Company

Il me semble que c'est la societe XXX (qui n'est pas une societe d'assurance) qui a indemnise des clients au taux de €433 308 donc:
The company XXX took upon itself to compensate the customers with a total amount of €433 308

the amount assumed by Company X

while the amount assumed by Company X was €433,308.

has not neglected paying (as compensation)

Hello,

"Having kept as one's responsibility" (ayant conservé à sa charge), means that the company has not backed out of paying the compensation amount of XXXX.

I hope this helps.
