Le principe du droit procédural français selon lequel les juges ne peuvent décider valablement que lorsqu'ils siègent et lorsqu'ils délibèrent en nombre impairs, ne s'applique pas à l'organisation du Conseil de Prud'Hommes. Dès lors que les deux Conseillers prud'hommes qui siègent ensemble ne peuvent se mettre d'accord pour rendre un jugement à l'unanimité, le Code du Travail prévoit qu'ils doivent faire appel au juge du tribunal d'instance qui siège dans le même ressort. Sous la présidence de ce magistrat, une nouvelle audience est alors tenue qui se nomme " audience de départage ".
