Pursuant to the provisions of the Contribution Agreement, XXX will, following final completion of the present agreement –be fully empowered, on behalf of Airbus Defence and Space and relating to the assets contributed to this company, to institute or continue where necessary all legal proceedings and arbitration proceedings, grant all approvals necessary to all decisions, receive or pay any amount of money owed as a result of such actions, proceedings and decisions.

Mainly, XXX shall be entitled to institute or continue any legal or arbitration proceedings in order to defend and protect any right attached to delivered or pending contributed (I) domain names, (II) trademarks and (III) patents including the defence against infringements initiated before final completion of the present agreement.

Estoy un poco confundida .... ¿se refiere a "formalización"/"entrada en vigor", o no tiene nada que ver?

Me parece que el contrato (agreement) ya existe. Creo que se refiere a lo que puede pasar antes de que se hayan cumplido todas las condiciones del contrato.
No habla de "an agreement", sino de "the present agreement".
