This document relates to a group health insurance plan and this article PRESCRIPTION - TIME LIMITATION) deals with the time barring of claims in the case of non-disclosure, omission, false declaration, etc. Then we have reasons for time barring starting from, not the event giving rise to it, but, in the case of a third party action against the Insurer, the date when the third party brought the lawsuit against the Policyholder or Beneficiary, who then bring a lawsuit against the Insurer. Time barring is interrupted by ordinary causes for interruption of time barring set out in articles 2240 to 2246 of the Civil Code, and include:

"la reconnaissance par le débiteur du droit de celui contre lequel il prescrivait."
I am totally stumped by this sentence. Please can somebody clarify for me what it means?

Le débiteur > could be the insurer who has 'présenté une offre d’indemnisation': pls. see the first web ref.

Distinguish between time-barring of the right to sue and of the effect of stopping the time running for the underlying remedy 'pour la totalité de la créance un effet interruptif qui ne peut se fractionner' > the claim or 'chose in action' cannot be severed so split up, with one part time-barred rather than another part.

BTW, false declaration: or statement, contractual or criminal misrepresentation vs. negligent mis-statement.

L’article 2219 du Code civil énonce que « la prescription extinctive est un mode d’extinction d’un droit résultant de l’inaction de son titulaire pendant un certain laps de temps« .
