In a note to a presentation reporting on the work of the German Federal Court of Audit examples of non compliance with public procuremtn regulations are given, among them being:
Fehlerhafte Annahme vergabefreier Inhouse-Geschäfte:
In-House-Geschäfte (also ohne jegliche Vergabeverfahren) werden getätigt, obwohl die kommunale Gesellschaft, das **Wesentlichkeitskriterium** (also im wesentlichen für die Kommune tätig zu sein) und/oder das **Kontrollkriterium** (also ohne Beteiligung Privater an der Gesellschaft) nicht erfüllt sind.
I have put both criteria together because I suspect that there are standard English expressions which I am not aware of. Would anyone say "substantiality criterion"? It does not sound right. Do standard expressions exist for these two criteria in public procurement law for evading the requirements of inviting to public tender or may one translate the expressions as one feels? Help and comments much appreciated.
