Italian term

a proprio nome e per proprio conto

Non-PRO Italian to English Law/Patents Retail license agreement
Moderators: I have listed 'both' terms as they appear to mean the same thing, though literally "under their own name and on their own behalf/accountf (hence without a mandate" - noting that this is a Distributor whereby the term "propriety trader" may not apply to "proprio conto" (stock traders).

I am dubious about the "under their own name" and how this is properly termed, legally, and in context with "per proprio conto."

Text: "DISTRIBUTORE tale termine designa qualunque soggetto che, agendo a proprio nome e per proprio conto (pertanto senza alcun mandato), ...

Thanks.

When entering new questions, KudoZ askers are given an opportunity* to classify the difficulty of their questions as 'easy' or 'pro'. If you feel a question marked 'easy' should actually be marked 'pro', and if you have earned more than 20 KudoZ points, you can click the "Vote PRO" button to recommend that change.

How to tell the difference between "easy" and "pro" questions:

An easy question is one that any bilingual person would be able to answer correctly. (Or in the case of monolingual questions, an easy question is one that any native speaker of the language would be able to answer correctly.)

A pro question is anything else... in other words, any question that requires knowledge or skills that are specialized (even slightly).

Another way to think of the difficulty levels is this: an easy question is one that deals with everyday conversation. A pro question is anything else.

When deciding between easy and pro, err on the side of pro. Most questions will be pro.

* Note: non-member askers are not given the option of entering 'pro' questions; the only way for their questions to be classified as 'pro' is for a ProZ.com member or members to re-classify it.

Discussion

Anna ZANNELLA (asker) Jul 8, 2013:
I wouldnt quote EU-Lex as I am quite likely to have translated it as well ask the question here (!) I am all too familiar with how those docs are done. I am unsure as to "name" as a referring to legal entity for a business. Which name? Bill Smith or Smith Distributors?

OOPS, left out a bit of the English text in the EUR-Lex example:

In any event, the distributors were acting in their own name and on their own behalf and not as XXXX's agents

And again:
“DISTRIBUTORS” is understood to mean all companies or legal entities other than AFFILIATES acting in their own name and on their own behalf that purchase packaged or non-packaged PRODUCTS for resale.

2 KudoZ points awarded for this answer. Comment: "The name bit doesn't appear to address a business name as a legal entity. There is room for interpretation here should things become litigious .... I don't know why this acceptable ..."
