français term

créance abstraite

français vers anglais Droit / Brevets Finance (général) Mortgage claim
'Créance abstraite incorporée dans la cédule hypotécaire en 1er rang de CHF...'

This is from a Swiss demand for payment of mortgage arrears for a holiday chalet. Help with 'en 1er rang' would also be much appreciated.

1er rang means that the debt has priority over other debt
FoundInTrans Feb 14, 2013:
Please post 1er rang since I have found that one.

I dunno, I looked through a few Google hits and I'm not sure I'd say it's all that clear to me what it means, let alone how to render it in English.

Have you tried Googling it? I found several sites explaining what it means.

abstract claim

Here, "abstract" = effective without the requirement of an underlying "cause" or consideration (F.H.S. Bridge)

And 'cédule hypothécaire' = mortgage note, if you're willing to gloss over the difference between a civil-law hypothec and a common-law mortgage; = hypothecation instrument, if you're not willing.
