Hello all,

I am translating a lawyer's letter dealing with his client's questions concerning inheritance.

Not at all sure how to translate this particular part.

The previous paragraph spoke about how the estate is split up between the deceased's spouse and children.

There are several properties in the estate and the letter states:

""I tri eredi (moglie e due figli) concorrono ciascuno per 1/3, ma al coniuge, oltre alla quota di eredità, spetta un diritto di uso esclusivo delle casa familiari sfruttate da entrambi i coniugi."


"Il coniuge superstite, pertanto, ha diretto di **mantenere il contatto esistenziale** con le due abitazioni tenuto conto dell' affectio coniugalis e della indissolubilità dell'intreccio della matrimoniale relazione anche oltre la morte del marito."

I understand this: the children will own 1/3 of the houses but their mother is the only entitled to live in them (one was a summer house). Is that right?

"Contatto esistenziale" non è un concetto giuridico, dovrebbe indicare proprio un legame di natura affettiva/morale. Per la definizione di "diritto d'uso" consiglio la lettura dell'art. 1021 del codice civile italiano. :)

I understand the same as you: she has the "right to keep her existential contact" with the houses, because she bought them with her husband, and even though the children might inherit 1/3 each, they are moraly (if not property-wise) the parent's homes and not the children's.

I know what you mean, it occurred to me also. I was thinking in terms of "household" (the property and those living in it), however if we are talking purely in property terms then you are right.

something like " consequently, the surviving spouse is entitled/has the right to retain the "hedonic relationship" with the two homes ..."

Esistenziale in Italian legalese means "the joy of living" (not enjoyment - something else)and danni esistenziali are the loss of a person's right to the joy of living.

An alternative answer based on the interpretation of "existential" as something experienced or material (see: http://www.merriam-webster.com/thesaurus/existential)
i.e. "the right to maintain material contact with the two homes"

This is my personal interpretation, as I suppose (?) there is no "technical" translation for this expression.

under a liferent and fee arrangement (i.e. ownership is regulated one way but rights of use differ from this)

The context helps I think:

"I tri eredi (moglie e due figli) concorrono ciascuno per 1/3 [=EACH RECEIVES A 1/3 SHARE OF OWNERSHIP], ma al coniuge, oltre alla quota di eredità, spetta un diritto di uso esclusivo delle casa familiari sfruttate da entrambi i coniugi." [=SPOUSE RECIEVES SHARE OF OWNERSHIP PLUS EXCLUSIVE RIGHT TO USE THE PROPERTIES].
This means that the other two heirs have an ownership share, but no right to use the property, so they have ownership without possession.

A liferent and fee arrangement is precisely one in which ownership and possession are split.
