Italian term

subentra

Italian to English Law/Patents Law (general) wills
Hello all,

I am translating a lawyer's letter dealing with his client's questions concerning inheritance.

Not at all sure how to translate this particular part of a lengthy sentence:

"Nell'Ordinamento giuridico italiano se il coniuge superstite ** subentra in successione legittima** (senza testamento) e concorreno due figli, ad esso è riservato, ex art.542 Codice civile, 1/3 del patrimonio del de cuis (soggetto deceduto)."

UK English please.

Many thanks for any suggestions!

inherits under the rules on intestacy

if you consider the term "successione legittima" it makes a lot more sense.

This describes a situation in which the person died intestate.

steps directly into the estate ...

of the deceased who is intestate, then Italian law decides who is going to inherit and how much (Successione legittima).

You may want to read up on Italian succession and probate at the link below. Very clear explanation of the relevant terms written for foreigners!
