On second thoughts: fact in issue, or probandum (see Black's Law Dictionary - an essential proposition to be approved by witness, affidavit, discovery, etc.

Si sono la stessa cosa e si riferisce alle domande fatte dalle parti di un procedimento penale ai testimoni e/o all'imputato.
In UK non esiste un vero equivalente, io andrei per una traduzione funzionale.

élément de preuve is what they call it in French.
