Unterlassung se traduit comme négligence, faute par abstention, défaut d'exécution, mais je crois que dans ce cas il s'agit de la première traduction.

disagree  Endre Both: Unterlassungserklärung bedeutet das Eingehen einer rechtlichen Verpflichtung, etwas nicht mehr zu tun, mit Unterlassung im Sinne von Nachlässigkeit hat das nichts zu tun.
