Source text - English All information concerning the Agreement (including the prior negotiations) such as but not limited to the forecasts, rates and commercial conditions agreed to herein, or information otherwise obtained in its course including any information regarding the general business of XXX, and which is not available publicly, shall be kept confidential and not used for any other purpose than the Agreement. Such information will not be published or discussed with any person not a Party to the Agreement, without the prior written consent between the Parties, except as set out in 22.3 below.

Each Party may make confidential information available only to those of its directors, officers and Employees (including officers and Employees of any of its affiliates) as well as consultants, suppliers and advisers who are directly concerned and whose knowledge of the Confidential Information is essential for the purpose of this Agreement.

Information which a Party is required to disclose by reason of law or order of a court of a competent jurisdiction may also be disclosed for such purpose. This clause shall survive for a period of 5 years from the termination or expiration of the Agreement.
