This term has come up before but with differing renderings. I am now asking colleagues what they would use as an equivalent.

When deciding between easy and pro, err on the side of pro. Most questions will be pro.
* Note: non-member askers are not given the option of entering 'pro' questions; the only way for their questions to be classified as 'pro' is for a ProZ.com member or members to re-classify it.

Une ordonnance de non-conciliation stipule que lorsque lies effets de la dissolution d'un marriage commencent, tous les deux divorcés ou épouses (précédemment conjoints) résideront séparément.
Des démarches (des procédures) juridiques décideront ce qui va se passer avec les enfants et la propiété ou les biens précédemment partagés.

It's been asked and answered lots of times, at least 6, including far more recently and far more than 2 renderings given as well.
Some have left it in French with an explanation as there is no exact equivalent in English but some have translated as 'order pendente lite' which basically says what the order is or intended to be
Anyway, I just give a literal translation (with explanation if it's not clear from the context) as in my lethier avocat link if I come across it.
If you have looked at all the answers and are still unsure you could have explained your uncertainty when asking, or ask the Answerer to explain further.
It has indeed been asked before and I saw the replies given in 2004(?). There two diffferent renderings 'non reconciliation'order and 'non conciliation' order. This is why I though 17 years later, a different and more consistent response might come up !If you look up 'ordonnance de non conciliation' you may see that it is not to do with 'reconciliation' unless I do not understand the meaning. |

Comment se déroule l’audience de conciliation ?
L’époux qui n’a pas déposé la requête est convoqué par le greffier par courrier recommandé avec avis de réception au moins 15 jours avant l’audience (article 1108 du Code de procédure civile).
L’audience se déroule « en cabinet » c’est-à-dire dans le bureau du juge. L’audience n’est donc pas publique.
Le jour de l’audience, le juge va écouter séparément l’époux en demande et l’époux en défense sur le principe du divorce. Autrement dit, il va demander à chacun des époux s’il souhaite accepter le divorce sans en évoquer les motifs.
Si les époux entendent accepter le divorce, ils signent le jour-même avec leurs avocats respectifs, un procès-verbal d’acceptation du divorce.
En tout état de cause, même si un tel procès-verbal est signé, le juge va écouter l’argumentation de chacun des avocats des époux sur les mesures dites « provisoires » car il a l’obligation de fixer de telles mesures.

En fonction du divorce engagé par les époux, la procédure de séparation comporte plusieurs temps forts. Le jugement ou l'ordonnance de non-conciliation est une des étapes. L’ordonnance constate judiciairement la volonté des époux de divorcer et fixe les mesures provisoires jusqu'au prononcé du divorce. Ces mesures concernent la résidence séparée des époux et le montant de la pension alimentaire.
