"co-minglement" veut dire à mon avis que le bailleur a le droir de verser la caution sur son compte personnel et l'utiliser comme bon lui semble

J'avoue ne pas savoir si ce droit existe en France mais une proposition de loi a été introduire pour la création d'un compte bloqué séparé du compte personnel du bailleur:
"« Le bailleur doit placer le montant du dépôt de garantie sur un compte sur livret spécifique, distinct de ses comptes personnels, auprès d'un établissement de crédit visé aux articles L. 512-87 et L. 512-88 du code monétaire et financier au taux d'intérêt pratiqué habituellement pour des dépôts d'épargne de ce type avec un délai de préavis de trois mois. Ce compte bloqué au nom du preneur est néanmoins ouvert en faveur du bailleur en cas de manquement"
