Strafanzeige und Strafantrag

German to English Law/Patents Law (general)
The two terms always appear as a pair. Can I get away with translating the pair of them with "complaint", or are there subtle legal differences? If so, what terms do I use in English?

Translation depends on context You probably need to explain. Yes, you can translate both as complaint if it doesn't matter to the reader. Or you may need to explain: 1) Strafanzeige: anyone may make a complaint to the criminal prosecution authorities/the police; 2) Strafantrag: only the victim may apply for prosecution, otherwise there will be no prosecution. E.g. defamation: the public prosecutor will never pursue that unless the victim wants it (in English/US law defamation would be a civil matter).

Strafantrag stellen - This most certainly is a criminal case. In the case of an Antragsdelikt, the victim has to apply for prosecution. Take libel or slander, which are usually civil actions in common-law countries - in Germany they are criminal, but they will only be prosecuted if the victim makes an application.

Re Strafantrag - there are not really private prosecutions in German (or American) law, at least there are, but only in the case of a few minor offences. In German law there are Antragsdelikte and Privatklagedelikte, which are difficult to keep apart and I think overlap. Take defamation (Verleumdung, üble Nachrede): this is a criminal offence, but the public prosecutor will not pursue or prosecute it unless the victim makes a Strafantrag, an application for prosecution - then, however, the public prosecutor will pursue it.

In Österreich entspricht der Strafantrag der formellen Anklage durch die Staatsanwaltschaft. Bei kleineren Delikten wird die Anklage Strafantrag genannt.
Strafanzeige ist meines Wissens nach die Anzeige bei der Polizei oder Staatsanwaltschaft, aufgrund der das Ermittlungsverfahren eingeleitet wird.
