No, not really, since as I indicated in my post below the Law of Obligations clearly distinguishes three different "saneamiento" obligations: 1) “saneamiento por evicción”=warranty of (good) title (or) warranty against loss of title (seller warrants that buyer will have legal possession and quiet enjoyment of the purchased property); 2) “saneamiento por cargas o gravámenes”=warranty of clear title (or) warranty against hidden charges/liens/encumbrances (seller warrants that the property sold is free of charges/liens/encumbrances) and 3) “saneamiento por vicios ocultos”=warranty against hidden/latent defects (seller warrants that goods are free of hidden/latent defects and generally undertakes to replace or repair any goods found to be defective).

Are you changing your mind about clear title? As intimated, it might still include clearing encumbrances: Quote 'Examples of clouds on title include a property's address being misspelled in a deed conveying title, a *mortgage (AmE) lien = (BrE) charge whose repayment hasn't been officially recorded*, a deed which has been signed but hasn't been properly recorded, *an easement that has not been properly recorded*, *unpaid property taxes*, a failure to transfer property rights (such as mineral rights) to a former owner of the property, and a *pending lawsuit* before a court of law over ownership to the property. A cloud on title is generally considered synonymous with a title defect.' Unquote

In other respects, I believe that indemnification/hold harmless undertakings are usually present in a contract when one party agrees to indemnify and hold the other party harmless (i.e., free of liability) in the event of a lawsuit or claim by a third party relating to the subject of the agreement. Two sample indemnification/hold harmless clauses:

“The Contractor shall defend, indemnify and hold the County, its officers, officials, employees and volunteers harmless from any and all claims, injuries, damages, losses or suits including attorney fees, arising out of or in connection with the performance of this Agreement, except for injuries and damages caused by the sole negligence of the County.”

“Sponsor agrees to indemnify, defend, and hold harmless AMC and its trustees, officers, directors, employees and agents, including Principal Investigator (“Indemnitees”) from and against any loss, expense, liability, damage, claim (including reasonable attorneys’ fees)(“Claim”) made or brought on behalf of a Subject for personal injury, including death, that arises out of the study drug, a protocol required procedure, or Sponsor’s negligence or willful misconduct and omission.”
